The Chipper Loyalty & Rewards Program Terms
Who Can Join?
The Chipper is available to any customers of NOBULLPROJECT.com. Non-US residents (those not residing within the contiguous US) are eligible to join and earn points but may be excluded from certain promotions and are not eligible to receive free shipping benefits.
How Does It Work?
Become a member by registering for an account at: https://www.nobullproject.com/account/register. Upon signing up for a Membership, individuals will receive an email confirming their Membership with The Chipper. Only one (1) membership with The Chipper is permitted per person, per email address.
What rewards can I receive from The Chipper?
Members are eligible to receive free shipping benefits with their purchases, based on which tier of The Chipper they are in.
- Member: Free Shipping on Orders $99 and Over (contiguous US)
- Insider: Free Standard Shipping (Contiguous US)
- Exclusive: Free Standard Shipping (Contiguous US)
- VIP: Discounted Expedited Shipping (Contiguous US)
Additional benefits include but may not be limited to: VIP Tier only Birthday Gift (annually, once per calendar year), occasional Early Access to select product releases, possible sweepstakes and potential special members only promotions or events.
Earning Points
Customers can earn points by performing the below actions:
- Create an Account: Reward: 5 points
- Points for Purchase: Reward: earn 1 point per $1 (USD) spent
- Leave a Review: Reward: 10 points
- Instagram Follow: 5 points
- Like on Facebook: 5 points
- Follow on Spotify: 5 points
- First Purchase Reward: 20 points
- First bag or accessories purchase: 20 points
- First Trainers purchase: 20 points
- First Runners purchase: 20 points
Restrictions
Rewarding verified buyer reviews only, meaning reviews written by customers who purchased the product and received an email from NOBULL to review it
When a product is returned, the points earned from that purchase will be subtracted from your account balance. (see “Refunds”)
Tiers are based on numbers of points earned annually, as follows:
- Member: 0-499 points
- Insider: 500-999 points
- Exclusive: 1,000-1,999 points
- VIP: 2,000+
Earning and retaining tier status
Once a tier is entered, customers will retain the tier for the remainder of the current calendar year and the following year. For example, a customer who entered a calendar year-based tier in November 2018 will retain that tier until Dec 31st, 2019. Only actions from the past calendar year will be counted toward tier eligibility.
Example 1:
A Nobull customer earns 400 points in 2023 making them 100 points shy of entering into the Insider tier. Beginning January 1st, their earning eligibility towards Insider will reset to 0 and the customer will need to earn 100 points in 2024 to enter into Insider.
Example 2:
In 2023, a Nobull customer earns 500 points entering them into the Insider Tier. In 2024, they must earn 1,000 points in order to enter into the Exclusive tier. If they do not earn 1,000 points by December 31st, 2024, for 2025 they will be in a lower tier based on their 2024 points earnings. Ex. If the customer earned 500 points in 2024 they will remain in the Insider tier but if they earned less than 500 points in 2024 they will earn the Member tier for 2025.
Email Communication
Upon signing up for The Chipper, individuals will sign up to receive emails regarding special members only offers and events, as well as new features of The Chipper. These communications would be in addition to general marketing communications from NOBULL about NOBULL products.
NOBULL marketing and The Chipper marketing emails will include opt-out instructions should individuals no longer want to receive any of these types of NOBULL communications. If a customer opts-out of marketing emails, they will no longer be able to receive any communication related to members only offers and events offered by The Chipper.
Cancellation of The Chipper account
For Members who decide they want to cancel their membership with The Chipper can use the Contact Us section of the Help page and include the email address of The Chipper account they wish to cancel.
Cancellation of an account with The Chipper cancels the Member's entire account on NOBULLProject.com. If a Member decides to cancel their membership with The Chipper, all unused points will be cancelled. If the Member subsequently signs up to become a Member again we will not reinstate the previously cancelled, unused points or rewards.
Refunds
- If a customer's order is Refunded, any points earned from the purchase will be removed from that customer's account.
- When a customer makes a purchase for a sum that isn't a round number (whole dollars only), their point balance will be rounded down to a whole number. The same applies for refunds.
- If a customer earned points on a purchase and then that purchase is partially refunded, their points are reversed. They then earn points only for the remaining amount.
- For example: If a customer earned 100 points for spending $100, and is then partially refunded $75, the number of points earned would get reduced to 25 - the remaining amount paid by the customer.
Tier Status
Tier status will be recalculated upon a refund, meaning the system will look at the number of eligible points a customer has towards their current tier. If the recalculation results in the customer dropping out of the tier attribution (and any relevant rewards earned when entering the tier) will be reversed.
Agreeing to NOBULL's Privacy Policy & Email
NOBULL values your privacy. BY REGISTERING FOR MEMBERSHIP IN THE PROGRAM, YOU AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN AGREES) TO BE BOUND BY NOBULL'S APPLICABLE PRIVACY POLICY AND OUR WEBSITE TERMS OF USE, including the agreement to arbitrate disputes. As is explained in our privacy policy, we use, and retain the information we collect to, among other things, detect security incidents, and protect against malicious, deceptive, fraudulent, or illegal activity, including attempts to manipulate accumulated points and benefits or to violate these Terms.
Changes, Termination and/or Removal From Program
Program Changes: NOBULL may, in its sole discretion, alter, limit, or modify the program rules, regulations, benefits, rewards, eligibility for Membership, or any other feature of the program (including assigning any of its obligations to customers under the program at any time to another person or entity, without recourse) or may terminate the program any time at its sole discretion, by posting any such changes on the NOBULL website.
YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING SUCH CHANGES CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES.
Termination or Removal from Program: NOBULL reserves the right to exclude individuals from the program, remove points from a member’s The Chipper account and/or cancel orders that are not consistent with NOBULL policy in its sole but reasonable discretion. In particular, any abuse, manipulation or "gaming" of the program or its rules (as determined by NOBULL) including multiple redemptions of Points by the same individual via different accounts, failure to follow any terms of the program, Membership inactivity for more than 12 months, reselling rewards, any misrepresentation or any conduct detrimental to the interests of NOBULL not otherwise protected by law may subject members to Membership revocation or deduction of Points obtained through these abusive or manipulative activities, cancellation of orders and will affect eligibility for further participation in the Program. Membership is non-transferable and Membership purchases must be made by the member. If your Membership is revoked or otherwise cancelled, any Chipper Points in your account will automatically expire. NOBULL reserves the right to make changes to its Website and these Terms at any time. It is your responsibility to check or review these Terms from time to time to keep informed of any changes. By joining the Program, you hereby agree to be bound by any changes in the Terms.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NOBULL WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM, INCLUDING DAMAGES ARISING OUT OF CHANGES TO OR TERMINATION OF THE PROGRAM. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. TO THE EXTENT PERMITTED BY LAW, THE LIMITATIONS ON NOBULL'S LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BY AGREEING TO THESE TERMS, YOU WILLINGLY AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN WILLINGLY AGREES) THAT YOU HAVE RELINQUISHED YOUR RIGHT TO SEEK THESE DAMAGES FROM NOBULL AND THAT THIS IS A REASONABLE ALLOCATION OF RISK. THIS PROVISION DOES NOT APPLY TO NEW JERSEY RESIDENTS.
